Em decisão histórica, o Tribunal Superior Eleitoral (TSE) cassou os mandatos dos vereadores Devacir Rabello (PL) e Joel Rangel (PTB) de Vila Velha, por fraude à cota de gênero nas eleições de 2020. A investigação, iniciada após recursos do MPF, PDT e candidatos prejudicados, revelou que as candidaturas femininas dos partidos PTB e Democracia Cristã (DC) eram fictícias, utilizadas para cumprir a lei sem real intenção de campanha.
A legislação exige que cada partido ou coligação tenha entre 30% e 70% de candidaturas de cada sexo. No entanto, as candidaturas em questão não realizaram atos de campanha, obtiveram votações insignificantes e apresentaram prestações de contas zeradas, configurando fraude.
A defesa das candidaturas argumentou que a pandemia de Covid-19 e problemas familiares impactaram as campanhas. No entanto, o TSE, liderado pelo ministro Floriano de Azevedo Marques, considerou as justificativas insuficientes e anulou os votos das chapas envolvidas, redistribuindo os assentos na Câmara.
Com a cassação, Heliossandro Matos (PDT) e Fábio Barcelos (PP) assumem as vagas na Câmara Municipal.
Outras candidaturas do PTB também foram questionadas por fraude, como as de Serenila Boschetti e Deni Maura Almeida Pina, consideradas fictícias pelo TRE-ES. O PDT também contestou a candidatura de Elaine Mendonça da Silva Laures (DC), acusando-a de não realizar campanha e ter prestação de contas incompleta.
A decisão do TSE reforça a importância da cota de gênero na política e pune aqueles que tentam fraudar o sistema.
